Subletting Policy at KUMMUNI #
At KUMMUNI, subletting your apartment or room is strictly prohibited, whether it’s in exchange for money or for free. This policy is in place to maintain the integrity of our mid-term, fully furnished, and all-cost-inclusive housing solutions. Subletting any property under a KUMMUNI lease will result in the immediate termination of your tenancy and could lead to serious legal consequences, including a lawsuit filed by KUMMUNI.
Facing Financial Difficulties? #
If you are currently facing financial difficulties, we strongly encourage you to reach out to our customer service department or your assigned agent. While we cannot permit subletting under any circumstances, we are committed to finding a solution that may help ease your situation.
Alternative Solutions We Can Offer:
- Relocation to a Lower-Cost Property:
If available, we may be able to offer you an alternative apartment at a lower cost. These options typically involve smaller apartments, as they tend to be more affordable. - Payment Flexibility:
In some cases, we may be able to grant you permission to delay one of your rent payments, providing temporary relief during financial hardship.
Important Note on Lease Extensions #
Please be aware that if there are concerns about your ability to continue affording the rent, we may not be able to offer an extension on your lease. However, our team is always willing to work with you to explore possible solutions that align with your current financial situation.
If you have any questions or need assistance, please contact our support team. We are here to help and support you in maintaining your tenancy at KUMMUNI.
Legal Implications of Subletting in Germany #
According to German law, a tenant may sublet their property under specific circumstances, such as experiencing financial difficulties. However, this is only permitted with the explicit consent of the landlord. Without this consent, subletting is not only a violation of your rental contract but can also be considered illegal. Specifically, subletting without the landlord’s permission can be viewed as a breach of contract, which can lead to eviction and potential legal action. In some cases, unauthorized subletting can also result in criminal charges under Section 291 of the German Civil Code (BGB) if it is associated with fraudulent behavior.
