Legally speaking, the landlord can hold the security deposit for up to 6 months. However, if specific conditions are met, the deposit will usually be returned sooner. Here’s a breakdown of the policy:
- If you have returned the property in good order.
- You did not receive any Mahnung (reminder notice) or Abmahnung (warning) during your tenancy.
- You have no overdue rent.
- You do not have a Nachzahlung (over-consumption).
If all these conditions are fulfilled, your deposit will be returned to your bank account within 2 months* after submitting the request for its return.
* Updated Terms (Effective November 2024):
- The minimum period for returning the deposit has increased from 2 months to 3 months.
- This change ensures all calculations, such as utility consumption and necessary reconciliations, are completed accurately.
- This updated policy applies to rentals with a maximum stay of 11 months.
- For tenants extending their contracts and staying longer than 12 months:
- By extending, tenants agree that KUMMUNI may hold the deposit for up to 6 months.
- This is to ensure there are no over-consumption charges or unresolved issues.
